Payment for all adverts must be made by the date of the booking deadline. Interest may be charged by the Publisher on any amount not paid within the agreed term at the maximum permissible rate in terms of the National Credit Act 34 of 2005, as amended. Should legal action be instituted for the collection of any amount owing to Vanilla Publishing, all costs on the scale as between attorney and own client, including collecting commission and tracing charges will be due and payable by the Advertiser. The Publisher will not cancel an order where cancellation of the order is received less than 30 days prior to the publication date (Magazines will be published at the Publisher’s discretion. Publication date will be deemed to be the first day of the month in which the advert is to appear). Any cancellation must be in writing. The Advertiser must supply the Publisher with all the artwork, material, copy and layout of the advertisement (the Copy) no later than the artwork deadline detailed from time to time in accordance with the specifications detailed by the Publisher from time to time. The Publisher may in its sole discretion produce Copy for the Advertiser and shall charge the Advertiser at the Publisher’s then current rates. The Advertiser warrants that the Copy: 1) Does not infringe any applicable law(s), and 2) does not defame any person, organisation or group. The Advertiser indemnifies the Publisher, its distributors and agents, against all liability whatsoever arising out of the publication of the advertisement. The Publisher shall not be responsible or liable in respect of any loss or damage to the Copy whilst in possession of the Publisher. The Publisher shall not be liable for the failure of the advertisement or any part thereof failing to appear. The Publisher has the sole and absolute discretion to refuse to place any advertisement for any reason whatsoever, which reason needs not be disclosed, and the Advertiser shall have no right of recourse whatsoever against the Publisher for our refusal to place the advertisement. The Advertiser shall provide the Publisher with the physical address in respect of any mail order advertisements. These terms constitute the entire terms and conditions between the Advertiser and the Publisher and any amendment shall be reduced to writing and signed by both parties to be of any force or effect. Vanilla Published adheres to all POPI laws.
I confirm that I am duly authorised to enter into this agreement and accept the payment terms as stipulated. I confirm that by my signature hereto, I bind myself as surety for and Co-principal debtor with the Company for the latter’s obligations to Vanilla Publishing Pty (Ltd).
